The California Labor Commissioner’s Office is offering amnesty to port trucking companies who misclassified drivers as independent contractors rather than employees.
The amnesty program, which was included in Assembly Bill 621, allows qualifying companies to avoid liability for employee misclassification. Since 2011, port truck drivers have filed 799 wage claims for misclassification, according to the California Department of Industrial Relations. The labor commissioner has awarded more than $35 million to port truck drivers in 302 of those cases.
