Federal Judge Allows Constitutional Challenge to Fee Schedule

A federal judge has cleared the way for a Georgia hospital to continue a constitutional challenge to Kentucky’s hospital fee schedule. Judge Gregory F.  Van Tatenhove with the U.S. District Court of the Eastern District of Kentucky on Wednesday denied a motion by claimant Marcus Hobbs to dismiss a lawsuit filed by the Doctors Hospital of Augusta. Doctors Hospital filed a lawsuit asserting that it is unconstitutional to apply Kentucky’s fee schedule as to bills submitted by an out-of-state medical provider.
