The 1st District Court of Appeals ruled that a person who was sickened by asbestos could not sue the company allegedly responsible for his exposure, even though the California Supreme Court has ruled that employers have a duty to protect workers’ families from exposure though contact with fibers that come home on the employees’ skin, hair and clothing.
The 1st DCA said this precedent did not aid Allen Rudolph in his claim against his father’s company, Rudolph & Sletten, because Rudolph worked for the company, too.
