The third time was not the charm for a Louisiana workers’ compensation judge whose rulings continue to be overturned by the Court of Appeals.
Each time the judge has issued a decision resulting in the denial of benefits to the family of Filiberto Serna Jr., she has been reversed, and the Court of Appeals last week said the fact that Serna was an independent contractor is not a valid reason to deprive the survivors of compensation.
Serna was killed in a construction accident while attempting to move a series of trailers at a naval facility in Belle Chasse.
