New York State Workers' Compensation Board (SWCB) officials made it clear last week that no pre-hearing conferences will go forward in disputed claims cases without a report of prima facie medical evidence.
Chairwoman Donna Ferrara said in a bulletin, labeled Subject No. 046-188, that Gov. Eliot Spitzer's workers' compensation reform package sets a strict schedule for pre-hearing conferences and requires claimants to file medical reports prior to those hearings.
