A South Dakota claimants’ attorney will ask the state Workers’ Compensation Advisory Council to help push legislation to target uninsured employers.
Jim Leach will present a six-page memorandum to the council at its Oct. 11 meeting and ask members to back his proposal to tie employer proof of workers’ compensation coverage to their sales tax licenses.
The only remedy workers have against uninsured employers now in South Dakota is to go to court, but § 62-3-11 allows them to collect double indemnity benefits if they prevail.
