The North Carolina Supreme Court has denied review of an appeal by medical providers who argue that the Industrial Commission violated the state’s Administrative Procedure Act when it adopted an ambulatory surgery fee schedule, the commission announced.
The decision puts to rest a challenge by Surgical Care Affiliates seeking to overturn the price caps. The fee schedule that became effective on April 1, 2015, continues to be in effect, the commission said.
