The Georgia Court of Appeals last week ruled that the state Insurers Insolvency Pool is entitled to offset its workers' compensation liability from the proceeds that an injured woman received from insurance claims.
Pursuant to the Georgia Insurers Insolvency Pool Act, the court said, the settlements from an automobile liability insurance carrier and the worker’s own uninsured/underinsured policies should reduce her claim against the pool by the full amounts received.
