The Pennsylvania Supreme Court has declined review of a decision that found the Uninsured Employers Guaranty Fund was not secondarily liable for benefits to the employee of an out-of-state business that did not maintain coverage in the state.
Since Farmers Propane had secured the payment of benefits to Mark Salvadori under the comp coverage it maintained in Ohio, the Commonwealth Court said Farmers was not an uninsured employer for purposes of triggering the fund's liability.
