A New York appellate court ruled that a worker was entitled to summary judgment on his Labor Law claim for an injury he sustained while helping a group of coworker lower a cutting machine from the roof of a building.

Facts: Gidar Cuevas suffered injuries while assisting a group of workers move a roof-cutting machine from the top of the building to the ground 10 feet below.
