An Ohio appellate court ruled that a worker who made repeated unsuccessful claims for permanent total disability benefits for over a decade had foreclosed her eligibility by voluntarily abandoning the workforce.
Case: State ex rel. Patterson v. Industrial Commission, No. 16AP-786, 12/21/2017, published.
Facts: Leona Patterson worked as a bus driver for the Greater Cleveland Regional Transit Authority, a self-insured employer. She suffered multiple injuries in an on-the-job accident in March 1992, and again in April 2000.
Patterson never returned to work after the April 2000 accident.
