The Florida Division of Workers’ Compensation gave notice Tuesday that it has proposed a rule that will establish exactly how gruesome an injury must be to “shock the conscience.”
A definition is necessary because of passage of Senate Bill 376 in March. The bill allows first responders to qualify for benefits if they suffer post-traumatic stress syndrome, but only if they witnessed or treated patients who suffered "grievous bodily harm of a nature that shocks the conscience."
Lawmakers left it up to regulators to decide what that means.
