Repetitive trauma claims require an accident date and can be denied for failure to timely notify, an Illinois court ruled. The Appellate Court of Illinois 4th District rejected the claimant's contention that the 45-day rule of notice of injury or exposure did not apply to his claim. "The accident date in a repetitive trauma case turns on when certain facts would have become plainly apparent to a reasonable person, and such awareness can arise for the first time after termination of employment," the appellate court held.
