Failure to properly advise a FedEx driver of her right to file a worker's compensation claim tolled the statute of limitations until she became aware of her rights, the California 5th District Court of Appeal ruled in an unpublished opinion.
The court issued a sharply worded response in Federal Express v. WCAB (Uhlik), F051391, 12/28/06, to FedEx's argument that it didn't take a "rocket scientist" to realize that driver Jeanie Uhlik had a work-related injury. The employer made the argument, trying to show that Uhlik's claim for workers' compensation benefits was time barred.
