Proposed Rule Would Require MSF to Use NCCI Manual

The Montana State Fund would be required to adopt classifications from the National Council on Compensation Insurance Basic Manual for Workers’ Compensation and Employers Liability Insurance under rules proposed by the insurance commissioner.

A hearing notice published in the Montana Administrative Register says the proposed change is needed to ensure rules for Montana State Fund are the same as rules for other carriers who are also regulated by the commissioner.

Lawmakers in 2015 passed SB 123, relinquishing oversight responsibilities for the state-chartered carrier and handing them over to the insurance commissioner.

Proposed revisions would also supplement the NCCI Basic Manual to include revised classifications that have been approved by the commissioner’s Classification Review Committee since its last rule-making in 2008. The committee met in June and ratified NCCI classification filings from 2010 through 2016.

The Classification Review Committee is holding a meeting on the proposed revisions at 1 p.m. Sept. 11. The hearing is in the second-floor conference room at the Office of the Montana State Auditor building, 840 Helena Ave., in Helena.
