California’s Workers’ Compensation Appeals Board scheduled a hearing for Jan. 4 on proposed rules to implement a legislative mandate for claimants to file a declaration stating they are eligible to file a lien.
The rules are intended to implement Senate Bill 1160, which identifies the situations under which a claimant is allowed to file a lien. The bill requires claimants to declare under penalty of perjury that they satisfy at least one requirement for filing a lien, such as providing emergency services or treatment in cases where the employer denied care.
