Salvage Company Owner May Face Jail Over Attorney's Fees, $100,000 Settlement

The owner of a salvage company could be looking at jail time for failing to pay attorneys’ fees in a case in which he and his company were ordered to pay $100,000 to an injured worker, according to The Pennsylvania Record legal newspaper.

Jeffrey Schaffer, the attorney for injured worker Demetrius Thornton, said Post Delmar Partners and owner Kevin Brooks had failed to pay the settlement to his client as well as the $8,656-plus costs he owes Schaffer for filing the last motion for sanctions against them and accrued interest.

Schaffer asked the court to jail Brooks immediately and asked that he be kept incarcerated until he pays his obligations.

Schaffer said that Post Delmar Partners was not carrying workers’ compensation insurance when Thornton was injured from debris when he was outside an apartment building in which the company was performing an interior demolition.

Schaffer alleges that Brooks entered into the $100,000 settlement agreement to avoid penalties for not carrying insurance.
