The Wyoming Supreme Court last week ruled that a worker with an incurable neurodegenerative disease was not entitled to permanent total disability benefits because he failed to prove his inability to work was linked to a prior back injury as opposed to the progression of his illness.
Pete Hart had injured his back while working at Solvay Chemicals in 2005. He later established his entitlement to temporary disability benefits for his injury.
In May 2006, the Workers' Compensation Division awarded Hart permanent partial impairment benefits based on a 12% impairment.
