The California Supreme Court on Wednesday denied review of two workers’ compensation cases, including an employer’s appeal of an award of temporary total disability benefits for a psychiatric injury.
Last September, the Workers’ Compensation Appeals Board found that Timothy Kirby was entitled to TTD under the “odd lot” doctrine.
The doctrine recognizes that a worker who is partially disabled may still receive TTD benefits if his partial disability has resulted in a total loss of wages.
