Construction Worker Wasn't Entitled to Summary Judgment on Labor Law Claim

A divided New York appellate court ruled that an injured construction worker was not entitled to summary judgment on his Labor Law Section 240(1) claim for an alleged fall from a scaffold, though the defendants were entitled to partial summary judgment on his claims under Section 241(6).
