A Second District Court of Appeals for Ohio ruled that an employee who was struck in a crosswalk leaving a hospital after her shift had overcome the "coming and going" rule in filing her workers' compensation injury claim.
In the case of Janicki v. Kforce.com, no. 21183 (6/30/06), Judith Janicki filed a claim for workers' compensation benefits following an accident sustained while crossing a crosswalk. On December 31, 2002, Janicki finished her shift at Good Samaritan's emergency room and headed for her car, which was parked in the employee parking lot across the street.
