The Commonwealth Court of Pennsylvania found that although a workers' compensation judge found no disability related to a chest wall injury, the WCJ should have granted the worker's petition and then suspended benefits for an unrelated injury.
In Stein v. Workers' Compensation Appeal Board, No. 357 CD 2006, 08/09/2006, the court consolidated two cases. In the first case, Ronald Stein petitioned for benefits on Oct. 27, 2003, and alleged that on Jan. 2, 2001, he suffered a low back injury while lifting bags of salt at work. The Pittsburgh Board of Education denied Stein's allegations.
