The Texas Division of Workers’ Compensation has extended the public comment period on a proposed rule that seeks to answer the tricky question of when regulators should give parties that violate its rules a break on the penalty.
The state Legislature last year instructed the division to consider whether a violation impacted the payment of benefits, and the violator’s past compliance with electronic data interchange regulations, when determining the amount of the penalty.
