A divided Texas appellate court on Thursday revived a widow’s late-filed claim for death benefits, finding a triable issue as to whether she had good cause for her delay.
Encarnacion Diaz died at home in May 2010, one month after he suffered severe burn injuries while cleaning a fryer in the kitchen of a hotel.
His employer had workers’ compensation coverage from Zurich American Insurance Co., and Diaz’s employer timely reported the accident. Zurich informed the Division of Workers’ Compensation of the accident.
