An Oklahoma claimants’ attorney is anticipating losing an administrative-level case involving a worker who can’t see out of his right eye. Attorney Bob Burke said he also anticipates losing a potential appeal before the Workers’ Compensation Commission.
But Burke says his goal is to get the case to the Oklahoma Supreme Court, which he hopes will strike down a provision in the state’s new workers’ compensation statute allowing deferral of permanent disability awards.
