CWCI Joins Dispute on WCAB Jurisdiction over Billing Disputes

The California Workers' Compensation Institute last week filed an amicus brief in a dispute before the 4th District Court of Appeal on whether the Workers' Compensation Appeals Board still has jurisdiction to determine medical-billing disputes after the passage of SB 863.SB 863 amended the Labor Code to create a new administrative independent medical bill-review process, effective Jan. 1, 2013. The California Insurance Guaranty Association is arguing that this process is the exclusive means by which a care provider can contest the fee it wishes to collect for the services provided...
