QME Receives Letter of Reprimand

California’s Division of Workers’ Compensation issued a letter of reprimand to a qualified medical evaluator following an investigation into allegations of overbilling for medical-legal evaluations.
The DWC said its Medical Unit received a complaint regarding Dr. Behzad Emad, a QME specializing in both pain management, and physical medicine and rehabilitation. The division opened an investigation that resulted in five allegations of billing violations, but not evidence that he intended to commit fraud.
“The investigation into the current accusations against you yielded no clear evidence of intent to defraud,” the letter says. “Therefore, this matter is being settled short of the discipline possible under the sanctions guidelines, and instead by way of this letter of public reprimand.”
The letter advises Emad not to expect a similar outcome should the division receive similar complaints in the future. The division also noted that it could reopen the investigation file if it receives complaints in the future.
