Florida's First District Court of Appeals ruled that the term 'construction industry' in section 440.09, Florida Statutes, is to be interpreted broadly to ensure that workers performing hazardous activities are protected.
In Kurt Ficocelli Sr. v. Just Overlay, Inc., (no. 1D05-3155, 07/11/06), Ficocelli was working on the roof of a hangar at the Clearwater/St. Petersburg Airport applying sealant. He stepped backward onto a translucent panel, which gave way under his weight, and he fell approximately 35 to 40 feet to the concrete floor below. He suffered serious injuries.
