Florida's First District Court of Appeals ruled that the term 'construction industry' in section 440.09, Florida Statutes, is to be interpreted broadly to ensure that workers performing hazardous activities are protected. In Kurt Ficocelli Sr. v. Just Overlay, Inc., (no. 1D05-3155, 07/11/06), Ficocelli was working on the roof of a hangar at the Clearwater/St. Petersburg Airport applying sealant.
