An audiogram's compliance with Occupational Safety and Health Act standards is assumed unless contrary evidence is presented, a Pennsylvania court ruled.
In Bemis Co. Inc. v. WCAB, 333 C.D. 2007, 07/31/2007, the Commonwealth Court ruled that Dr. Mohammad Akbar's audiograms were reasonably relied on by the workers' compensation judge.
"... there was no objection to the audiograms relied upon by Dr. Akbar. Further, there is nothing in the record to indicate that the audiograms were not performed in accordance with OSHA standards," the court ruled in an unpublished opinion.
