The United States Court of Appeals for the 5th Circuit ruled last week that under the
Longshore and Harbor Workers' Compensation Act, the last employer of a worker who died from overall occupational asbestos exposure was liable, and that employer was not
entitled to credit for claimant's net settlement receipts from previous
