USCA: Employer Not Entitled to Settlement Credit

The United States Court of Appeals for the 5th Circuit ruled last week that under the Longshore and Harbor Workers' Compensation Act, the last employer of a worker who died from overall occupational asbestos exposure was liable, and that employer was not entitled to credit for claimant's net settlement receipts from previous employers.
