Benefits Cutoff at Age 62, Same as Social Security

The proper termination date for a widow's workers' compensation benefits is the month after she would turn age 62, the Kentucky Court of Appeals ruled. The court in Frazier v. Morsey, No. 2006-CA-000895-WC, 01/19/2007, ruled in favor of Cynthia Frazier, the widow of Daniel Frazier. She petitioned for review of an opinion of the Workers' Compensation Board dated March 31, 2006, which reversed and remanded the administrative law judge's opinion that terminated her widow's workers' compensation benefits on the date her late husband would have turned age 66.
