A man killed by a tree branch while working on his nephew's property wasn't covered at the time of the accident under the Industrial Insurance Act, the Washington state Division 1 Court of Appeals ruled.
The court, in an unpublished opinion, found there was ample evidence to support the denial of benefits to the man's widow. The case was Derricott v. Department of Labor and Industries of the State of Washington, 58385-9-I, 06/04/2007.
