The Ninth District of the Texas Court of Appeals held that a parent company who fails to prove the existence of workers' compensation insurance coverage and control over the claimant is not protected by the exclusive remedy provision.
In Koskey v. Baker Hughes, Inc., No. 09-04-539 CV, 08/11/2005, Richard Koskey was injured while working as a sandblaster for Baker Hughes Tubular Services, Inc. ("Tubular"). Baker Hughes, Inc. ("BHI") was Tubular's parent corporation while Koskey was an employee. Koskey sued BHI for his injuries.
