A disabled miner who waited on a Supreme Court decision about his claim before submitting pharmacy bills lost his chance at compensation, the Kentucky Court of Appeals decided.
In Carnes v. S.F. & S.Coal Co. Inc., No. 2006-CA-001234-WC, 09/29/2006, Doyle Carnes last worked for S. F. & S. Coal in 1994. In August 1995, he filed an application for benefits in which he alleged that he suffered from coal workers' pneumoconiosis because of approximately 23 years' exposure to coal dust in underground mines. He worked for several companies during his career, court records showed.
