The Oklahoma Supreme Court, in a split decision, ruled that an employee cannot sue his self-insured employer in bad faith for refusing to pay for his medication as ordered by a workers' compensation court, stating that the employee’s exclusive remedy lies in comp. In Kuykendall v. Gulfstream Aerospace Technologies (12/17/2002, #97036) Kuykendall filed pleadings in Workers' Compensation Court to reopen a prior court order for a change of condition, the worsening of a neck injury he had suffered.
