A security officer's 55% hearing loss would have been apparent to a reasonably diligent person years before he filed his claim, the Tennessee Supreme Court of the Workers' Compensation Appeals Panel ruled in denying the claim.
A trial court concluded that Haskell Sutton sustained a 55% permanent, partial disability to the binaural hearing as a result of work-related exposure to loud weapon noise.
