SACRAMENTO, Calif. -- California prosecutors have failed to find a sponsor for legislation that would allow them to file felony charges against business owners for failing to purchase workers' compensation insurance.
For at least three years, the Insurance Fraud Committee of the California District Attorneys' Association has been pushing legislation to make failure to cover employees a "wobbler," which would give prosecutors the discretion to file charges as a misdemeanor or a felony, said Gary Fagan, the committee chairman and a deputy district attorney for San Bernardino County.
