RI Nightclub Owners Say Fine Unconstitutional

Owners of the Rhode Island night club that burned down in February, killing 100, have filed papers appealing the $1.066 million fine for failure to carry work comp insurance, stating that it violates their constitutional rights. Michael and Jeffrey Derderian, through their lawyers, argued in papers filed Friday in Workers' Compensation Court that the fine is grossly disproportionate to other cases filed by the Department of Labor and Training.The law provides that the Department may impose a fine for each day that there was no insurance.
