The chairman of the Industrial Commission does not exert "undue influence" over other commissioners when he hears workers' compensation cases as part of a three-member panel, the Illinois 5th District Appellate Court ruled.
An employer charged that the chairman, because of his authority on the seven-member commission, can influence the other panelists' decisions. The Workers' Compensation Division of the 5th appellate court last week disagreed, saying that the chairman is only empowered as the sole authority over administrative functions.
