An employer must obtain approval from the Workers' Compensation Commission for release of a workers' compensation claim, the Illinois 2nd District Appellate Court ruled.
The employer in the case said it believed the release of all claims that its employee signed covered workers' compensation and uninsured motorist policy claims, but the appellate court disagreed.
The court reversed a trial court's finding that the release covered both types of claims. The case is Maxit v. John and Kelley Van Cleve, No. 05-L-1058, 08/22/07.
