New York 3rd Affirms Attorney Fee Award

The Third Judicial Department of the Appellate Division of the New York Supreme Court affirmed an award of attorney's fees that was less than 10% of the claimant's recovery. In Pavone v. Ambassador Transport, Inc., No. 96035, 02/16/2006, Frank Pavone was injured in 1999 and filed a claim for workers' compensation benefits. Pavone was represented by Ervin, McCane & Daly (the firm). In 2003, when the matter was concluded and Pavone had received an award, the firm submitted a $4,800 fee request.
