A workers' compensation judge was not required to have an employer present live testimony at trial to allow the judge to make credibility determinations, the Pennsylvania Commonwealth Court ruled in a claim and unreasonable contest case.
The employer in J. Evans Tucker Ltd. v. Workers' Compensation Appeal Board, No. 285 C.D. 2006, 9/27/06, was a business solely owned by J. Evans Tucker. The Workers' Compensation Appeal Board affirmed a workers' compensation judge's (WCJ) decision to deny Tucker's petition to join Nationwide Insurance Co. as an additional defendant in a claim petition.
