Texas legislator, Rep. Warren Chisum, R-Pampa, is footing a bill that would permit employers to freely dig into an employee's prior workers' compensation history, and immunize the employer from liability arising out of decisions based on that information.Stating that employers have the right to know about an applicant's work comp history if it is relevant to the job, Chisum's claim that the bill is necessary to prevent applicant fraud is drawing strong criticism from labor groups since statistics reflect that the bulk of fraud comes in fact from carriers and health care providers.
