A subcontractor who asserts control over an employee's work makes that person an employee of the general contractor as well, the Commonwealth Court of Pennsylvania ruled.
In Tim Britton Construction v. Workers' Compensation Appeal Board, No. 546 C.D. 2006, (08/15/2006), Eugene Carrick was working as a carpenter on April 27, 2001, at the United Electric (Unilec) job site when he sustained multiple injuries when the scaffolding on which he was working collapsed. He fell to the ground. Carrick filed claim petitions against general contractor Britton and subcontractor Wasicki.
