Kim Kardashian Sued by Workers' Comp Carrier Applied Risk Services

Applied Risk Services Inc. sued Kim Kardashian March 1 to subrogate for costs it incurred paying workers' comp benefits to a man who was involved in a car accident with her, according to the mynewsla.com website.

The lawsuit, filed in Los Angeles County Superior Court, concerns a 2014 incident in Beverly Hills in which Kardashian ran into a vehicle driven by Rafael Linares while he was on the job for John Paul Co. Inc., a plumbing company in Van Nuys, which Applied Risk insured at the time.

Linares also filed a personal injury lawsuit last year in Los Angeles asking that Kardashian cover medical expenses and property damage. He also is seeking compensation for a “loss of income and impaired earning capacity” due to the car accident, according to earlier press reports.

The lawsuit by Applied Risk asks for unspecified damages for all of the workers’ comp benefits it paid to Linares for injuries related to the accident, according to the report.

I propose that this is not even tangentially related to furthering our understanding of actual Workers' Compensation law or procedures. If it were not Kim Kardashian, this would merely be a reimbursement request arising out of a motor vehicle accident. If Kim were properly insured, the suit may not even touch her make-up money, although I am equally uninterested in which lip liner Kim prefers. Did Kim have Auto Insurance? Maybe 250/500K? That makes the story even less relevant.

WC Premium Fraud for under-reporting payroll? Working while on TTD? Violating the Porn Condom regulations? A millionaire driving Uninsured? Any of those would wander into the realm of interesting and/or educational news if Kim were publicized as an example.

Agree 100% with wcabdefense. Who cares? I read WCC for substantive information on legal issues, case law, legislation, industry trends etc.

I could have gotten this story in Us Weekly and tabloid news. And I avoid those publications (and Kardashian news) at all costs.

WCC can do better.

Agreed. WCC really? Celebrity gossip? This is an educational website. Not a tabloid magazine glorifying as the world does an individual who made her career out of a sex video? Who cares?! I clicked on it merely to comment as it shocked me as to the relevance on this site?

I find it interesting when a celebrity touches our little WC world. Funny how both of the earlier posters are incredulous that such a story would make its way on to WCC but nonetheless they took time out of their busy day to read it. Clearly the title was enough to alert you to the contents. I bet you secretly read the Star and the Globe, too, you little gossip hounds.

Stooping to the level of tabloids you are WCC. Why? Are you trying to attract those tabloid readers so as to increase your circulation? I'm thinking that many, if not all of us concerned with real issues in work comp would leave.

Meh, I back WorkCompCentral on this one. If you were the only one at the WCAB not to know about the celebrity claim, you'd be angry at WCC for not posting about it.

WCC is not an educational site alone. It is a news site that has educational elements. Therefore, any famous person who has an elevated ranking in the "newsworthiness" category is going to be written about. If you don't want to hear about Kim Kardashian, athletes, actors, politicians, don't click on the link.

Remember, you are the one holding the remote/mouse. If you don't like the TV show that's on tonight, remember that nobody is forcing you to watch it.

I don't like those trollish Taboola ads, so I never click on those. I hope WorkCompCentral never incorporates their advertising.
