SCOTUS Won't Review Decision Finding LHWCA Doesn't Preclude Asbestos Claim

The U.S. Supreme Court on Monday denied a petition to review a decision finding that the federal Longshore and Harbor Workers’ Compensation Act didn’t preempt a state-law damages claim for asbestos exposure against a maritime employer. The 5th Circuit Court of Appeals in June held the LHWCA did not prevent Ronald Barrosse from pursuing a state-law tort suit in Louisiana against Huntingon Ingalls Inc. for asbestos exposure.
