Bill Would Create Right to Private Action for Willfully Negligent Acts

Montana workers who are hurt due to willfully negligent acts would be able to seek damages against the person who caused the injury and receive workers’ compensation benefits, under a draft bill released Tuesday. The measure, currently identified as Legislative Concept 2208, by Rep. Jeremy Trebas, R-Great Falls, would give injured workers a private right of action against a third party for negligent, intentional and deliberate acts, in addition to the right to collect workers’ compensation benefits.
