Facts and procedural history: Kenneth Skahan worked for the Stutts Construction Co. He injured his back while at work in November 2004.
Dr. Lora Aller diagnosed Skahan with a chest and thoracic spine strain. Aller removed him from work, and Stutts paid temporary total disability benefits up until October 2005.
