The North Dakota Supreme Court on Thursday ruled that a worker’s claim for alleged mental and physical injuries from being trapped in a room during sub-zero temperatures was barred by the state’s statute of limitations.
Nicholas Lechner filed a workers’ compensation claim on May 5, 2016, for injuries he allegedly sustained on Dec. 5, 2013.
Lechner alleged he had been locked in a small room without a functioning heater when it was 30 degrees below zero outside. He claimed he screamed and banged on the door for hours before someone heard him and let him out.
