Jury Finds Manufacturing Company Retaliated Against Employees

A federal jury in Pennsylvania ruled that a manufacturing company and its owner unlawfully fired two workers involved in an investigation, the Occupational Safety and Health Administration announced.

The jury for the U.S. District Court for Eastern Pennsylvania said Lloyd Industries Inc., headquartered in Montgomeryville, and its owner, William P. Lloyd, retaliated against the workers for engaging in the protected activity of participating in a safety investigation.

OSHA filed the lawsuit in March 2016. The federal court will determine damages during a second phase of the trial.

“The U.S. Department of Labor proved the employer unlawfully fired workers for participating in a safety inspection,” said Oscar L. Hampton III, regional Philadelphia solicitor. “The jury agreed that the timing of these terminations was no mere coincidence and supported the workers’ legal right to a safe and healthy workplace.”
